Permission is granted to temporarily download one copy of the materials (information or software) on Sketch Theatre’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

4. Sketch Providers

Providers of sketchers:

  1. are solely responsible for all sketches submitted to Sketch Theatre and the consequences of posting the sketches on Sketch Theatre;
  2. grant Sketch Theatre a worldwide, non-exclusive, royalty free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the sketches;
  3. represent and warrant that the submitted sketches do not contain third party copyrighted material, infringe upon the intellectual property rights of any person or entity, contain pornography, sexually explicit or defamatory material, or violate the law in any manner;
  4. agree to indemnify, defend and hold Sketch Theatre and its owners and affiliates harmless from and against any and all claims, liabilities, damages, costs and expenses (including but not limited to attorneys’ fees) arising from the posting or use of the sketches.

Sketch Theatre reserves the right, in its sole discretion, to remove sketches at any time without prior notice and to terminate access to Sketch Theater at any time.

5. Limitations

IN NO EVENT SHALL SKETCH THEATER OR ITS SUPPLIERS, OR THEIR RESPECTIVE EMPLOYEES, AGENTS AND AFFILIATES, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT OR DUE TO BUSINESS INTERRUPTION) ARISING FROM THE ACCESS, USE OR INABILITY TO USE THE SITE OR THE MATERIALS ON THE SITE, WHETHER BASE ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SKETCH THEATER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO SKETCH THEATRE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE SUCH CLAIM OR CAUSE OF ACTION IS PERMANENTLY BARRED.

The materials appearing on Sketch Theatre’s web site could include technical, typographical, or photographic errors. Sketch Theatre does not warrant that any of the materials on its web site are accurate, complete, or current. Sketch Theatre may make changes to the materials contained on its web site at any time without notice. Sketch Theatre does not, however, make any commitment to update the materials.
